These terms cover any purchase from, or work with, Visibility Frequency, run by Nicole (Nikko) Bivens. A signed proposal or agreement for a specific project takes priority over these terms where the two differ.

Paying invoices

• Invoices are due 7 days after they’re sent, unless the invoice says otherwise.
• Pay online using the Pay button in the invoice email, by card or directly from your bank account. I don’t accept mailed checks.
• There’s no extra charge for any payment method.
• If a bank payment is returned or fails, a $25 fee is added to your next invoice.
• Work begins once a deposit or invoice shows as paid. Bank payments can take a few business days to clear.

Website Stewardship

• Website Stewardship is $149 a month or $447 a quarter, per website, billed in advance.
• It covers what’s listed on the Website Stewardship page. Content changes and larger projects aren’t included.
• Stewardship clients can request small content changes (text, images, buttons and links) at $150 an hour, billed in 15-minute increments. Founding members pay $89 an hour. Anything larger is quoted before I start.
• Founding members also get 30 Quick-Fix Minutes each month for small updates. They’re a thank-you on top of the plan, not part of what it pays for. Unused minutes don’t roll over and have no cash value.
• Founding rates and Quick-Fix Minutes last as long as your plan stays active. If the plan ends, they end with it.
• Stewardship needs Administrator access to your WordPress site. If that access is removed, care pauses until it’s restored.
• If monitoring finds broken links, I’ll send you a time estimate and fix them only once you approve.
• If one of my updates breaks something, I fix it at no charge. If a change you or someone else made causes a problem, I’ll let you know if I notice it, with an estimate to fix it.
• You can cancel anytime from your account link or by emailing me. Care continues through the end of the month or quarter you’ve paid for, and you won’t be charged again. There are no refunds for partial months or quarters.
• If a renewal payment fails and can’t be collected after about two weeks of retries, your plan ends automatically.

Page Reads and other products

• A Page Read is delivered within two business days of receiving your completed intake form. Forms received Friday through Sunday are due the following Wednesday.
• All sales are final. Page Reads, Hosting Consults, the Launch Pass and other products are non-refundable.
• If you hire me to move your site within 60 days of your Hosting Consult, the consult fee goes toward the move.

Projects and builds

• Each project follows its proposal: scope, price, timeline and payment schedule.
• Work outside the agreed scope is quoted before I start.
• Once a project is paid in full, the final deliverables are yours. I may share finished work in my portfolio unless you ask me not to. My own templates, frameworks and methods stay mine, and you’re free to use them as part of your finished project.

Your website, hosting and third-party tools

• You own your website, domain, hosting and accounts. Access you give me can be removed anytime.
• Your site depends on services I don’t control, like your hosting company, WordPress, themes and plugins. I’m not responsible for their outages, changes or failures, but as a Stewardship client I’ll help you through them.
• Backups and monitoring greatly reduce risk, but no service can guarantee a website will never have problems.

Talk to me first

If something about a charge or a project doesn’t feel right, email me first, before you contact your bank or card company. I’ll reply within two business days, and most things are sorted out in one conversation.

Filing a dispute or chargeback with your bank or card company cancels your Stewardship plan right away. Any other work I’m doing for you pauses until the dispute is closed.

No guaranteed results

I bring my full experience and care to every read, recommendation and build. How your business performs depends on many things outside my control, so I can’t promise specific results, sales or rankings. What you do with my recommendations is your decision.

Confidentiality

Anything private you share about your business, your website or your clients stays between us. I only use it to do your work.

Limits

To the extent the law allows, my total responsibility for any claim related to my work is limited to the amount you paid me in the three months before the claim. I’m not responsible for lost profits or other indirect losses.

Changes and contact

I may update these terms from time to time. The date at the top shows the latest version. These terms are governed by the laws of the State of Texas. If any part of these terms can’t be enforced, the rest still applies.
